The Shinde camp has committed a series of anti-party activities: the Thackeray faction submits to the SC

In a latest development in Maharashtra’s political crisis, the Thackeray faction has filed a joint rejoinder affidavit in the Supreme Court regarding the petitions pending before it filed by the Thackeray and Shinde factions.

A Supreme Court bench headed by Chief Justice of India (CJI) NV Ramana will hear the batch of pleas on August 3.

The affidavit urged the court to declare that the appointment of Eknath Shinde as chief minister as well as the subsequent election of the president are illegal.

Incurring disqualification requires no further deliberation as MPs from the Shinde faction have admitted by affidavit to forming a splinter group of 39 MPs.

It has been argued that MPs showed disrespect for the sanctity of the Supreme Court, engaged in anti-party activities and created a split/faction within the Legislative Party is very clearly confirmed by their own pleadings in the petition filed before the Election Commission of India where they claim there is a split in the party and claim the party symbol.

The affidavit further stated that the Eknath camp had committed a series of anti-partisan activities in goodwill with the BJP.

While calling the faction led by Eknath Shinde delinquent, the Thackeray faction, in its response, argued that the Shinde faction thereby incurred disqualification under the Tenth Schedule. Moreover, after committing a series of anti-partisan activities in bonhomie with the main opposition party in the state, namely the BJP, they outright violated the whip issued with regard to the election of the President on July 3, 2022.

According to the Thackeray faction, by voting in favor of the BJP candidate on July 7, 2022, against the candidate put in place by their own political party, the MPs of the Shinde faction had shown their renunciation of the party.

According to the Thackeray faction, the narrative now sought to be peddled by the Shinde faction that their electorate was unhappy with the decision to ally with the Nationalist Congress Party (NCP) and the Indian National Congress (INC) is denied by the fact that they continued to hold the cabinet sat in the government of Maha Vikas Aghadi (MVA) for almost 2.5 years and never raised such concern.

It has been argued that the Shinde faction concocted a rooster and bull story of how they were surprised by the party leadership’s decision to sever ties with their natural ally BJP and form a government with their enemies. naturals, namely INC. and NCP.

Depending on the response, this may very well be determined by the fact that at the national executive held on June 25, 2022, the leadership of Uddhav Thackeray was overwhelmingly affirmed while the conduct and actions of the delinquent MPs directed by Eknath Shinde have been vehemently criticized.

The petitioners argued that the Speaker’s bias can be seen from the fact that the Speaker issued notices on the disqualification petitions filed by Bharat Gogawale on July 4 against 14 MPs, but did not bother to issue notices. notice on disqualification BJP treated Shiv Sena as second year partner.
